Draft 1.0-draft: this text is pending attorney review and may change before it takes effect.

Terms of Service

Effective October 31, 2026. Between Markivia Digital LLC (“Markivia”, “we”) and the business that subscribes (“you”).

1. What Markivia is

Markivia is a subscription service that helps a business keep its online presence active. Depending on your plan, we create and host a website for your business, draft social media and Google Business Profile content for your approval, publish approved content to accounts you connect, collect inquiries into one inbox, and, where you have asked for it, manage advertising on your behalf. Markivia is operated by Markivia staff with the help of automated and AI-based tools.

2. Your account

You must be authorized to act for the business you sign up. Keep your sign-in details confidential and tell us promptly if you believe your account has been accessed without permission. You are responsible for the people you invite to your workspace and for the permissions you grant them.

3. Your content and approvals

You keep ownership of the business information, images and other material you give us. You grant us a licence to use it to provide the service, including to create drafts and to publish approved content on your behalf. Nothing is published to your accounts without an approval recorded in Markivia, unless you have expressly turned on automatic approval for a category of work. You are responsible for confirming that approved content is accurate and lawful, including prices, offers, licences and claims about your business.

4. AI-generated material

Drafts, images and website copy may be produced with AI tools from your approved brand information. We instruct those tools not to invent prices, offers, testimonials or facts, and Markivia staff review output, but errors can occur. Review every draft before approving it. AI-generated images are conceptual artwork and are marked as AI-generated; they are not photographs of your premises, staff or products unless you supplied them.

5. Connected platforms

To publish or read data, you connect accounts such as Facebook, Instagram and Google Business Profile through those platforms’ own authorization screens. We never ask for your platform passwords. Your use of each platform remains subject to its terms, and a platform may change or withdraw access at any time. You can disconnect a platform in Markivia at any time; we then stop using it and delete the stored authorization.

6. Advertising services

If your plan includes managed advertising, you are the advertiser of record and ad spend is billed by the advertising platform to the payment method you provide there, separately from your Markivia subscription. We set up and manage campaigns within the budget you approve. We do not guarantee results, lead volume or cost per lead.

7. Fees and billing

Plans are billed monthly in advance in US dollars through our payment provider. Prices are shown before you subscribe. Taxes are added where required. See the Refund and Cancellation Policy for cancellation, pauses and refunds. If a payment fails we will notify you and give you a grace period before service is paused; we do not delete your data because of a failed payment.

8. Our commitments

We will provide the service with reasonable skill and care, keep your workspace private to the people you authorize, keep records of what was delivered and approved, and keep backups. We do not promise uninterrupted availability or specific business outcomes such as sales, followers or search rankings.

9. Acceptable use

You agree to the Acceptable Use Policy. We may decline to publish, or remove, content that violates it or a platform’s rules, and may suspend an account used for unlawful purposes.

10. Privacy and your customers’ data

Our Privacy Policy explains what we collect. Where we handle your customers’ personal information, such as inquiries from your website, we do so as your service provider under the Data Processing Addendum.

11. Ending the agreement

You can cancel at any time, effective at the end of the current billing period. We may end the agreement with 30 days’ notice, or immediately for a serious breach. After cancellation you can export your records for 30 days; after that we delete your workspace as described in Data Deletion. Your website remains yours; we will assist with transferring the domain you own.

12. Limits of liability

To the extent permitted by law, Markivia is not liable for indirect, incidental or consequential losses, and our total liability under this agreement is limited to the fees you paid in the twelve months before the claim. Nothing limits liability that cannot be limited by law.

13. Changes

We may update these terms. We will notify you in Markivia or by email at least 14 days before a material change takes effect. Continuing to use the service after that date means you accept the change.

14. Governing law and disputes

These terms are governed by the laws of the state in which Markivia Digital LLC is organized and the United States. We will try to resolve any dispute informally first; contact us at husnain@markiviadigital.com.
